In order to fulfil the obligations imposed on us under the personal data protection provisions, we would like to inform you about the way we process your personal data and the purposes for which we do that. L.M. Group Poland Sp. z o.o. spares no effort to protect the privacy of people making use of its services. The Company has adopted a document called the Privacy Policy to follow the principles of the fair, honest and transparent processing of your personal data when you use our services. The Privacy Policy defines the way in which we care about your personal data and your rights.
1. DEFINITIONS
L.M. Group Poland Sp. z o.o. with its seat in Warsaw at ul. Zajęcza 15, 00-351 Warsaw, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw, 12th Economic Division of the National Court Register, under number KRS 0000874182, NIP (tax identification number): 5252845900.
Employers – entities that we look for employees for.
GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
Applicant – a person who sends his/her data to L.M. Group Poland in order to start a recruitment process, which can be done through a contact form available on the website, an application sent by electronic mail or an application sent as a response to a job advertisement placed on job portals.
2. YOUR PERSONAL DATA ADMINISTRATOR
L.M. Group Poland Sp. z o.o. is your personal data administrator in relation to the participation in recruitment processes organised by L.M. Group Poland Sp. z o.o.

3. PERSONAL DATA PROCESSED, OBJECTIVES AND LEGAL BASIS
As part of the recruitment process we process the following personal data: 1) surnames, 2) given names, 3) electronic mail addresses, 4) telephone numbers, 5) addresses of residence and correspondence addresses, 6) dates of birth, 7) information about professional experience, jobs and the course of career, 8) information about education, professional titles, schools applicants graduated from, 9) information about foreign language skills, official licences granted and practical skills, certificates and permits, and trainings and courses done, 10) information about applicants’ preferences regarding the expected remuneration, the time of starting work and professional preferences, 11) information about interests and hobbies.
The legal basis: your conscious and voluntary consent to participate in recruitment processes organised by L.M. Group Poland (in one certain recruitment process or a number of them depending on the consent given) and to receive assistance in building your professional career.
To determine, investigate and execute claims we reserve the right to process some personal data given by you, such as: given name, surname, date of birth, data about the use of our services if the claims result from the manner in which you make use of our services, other data needed to prove the existence of the claim, including the extend of the damage done.
Legal basis. Our legally legitimate interest to determine, investigate and execute claims, and to defend ourselves against claims in proceedings before courts and other state authorities.
In order to investigate complaints, examine requests and answer to your enquiries we may process certain personal data given by you, the data referring to the use of our services that are the reason for the complaint or request and the data included in the documents attached to the complaint or request.
Legal basis. Our legally legitimate interest to improve the functionality of services rendered electronically and to develop positive relations with applicants grounded on reliability and loyalty.
4. HOW DO WE PROCESS YOUR DATA?
When you apply for a job, we process your personal data by analysing and saving it on a database stored on a secure server. If you successfully complete a recruitment process and express your interest in the job offered, we send your data to the employer.
5. ENTITIES WE MAKE YOUR PERSONAL DATA AVAILABLE TO
We transfer your personal data to the following categories of recipients:
Employers We make your personal data available to employers who use our services. The employers we make your personal data available to independently determine the objectives and ways of processing the data, and are not obliged to follow our recommendations. Therefore, we are not responsible for their actions or omissions.
Service providers
We transfer your personal data to the providers of services we use when running our business. The service providers that we transfer your personal data to, depending on contractual terms and circumstances, either are obliged to follow our objectives and manners of processing the data (processors) or determine the objectives and manners of processing the data on their own (administrators).
Processors. We use the services rendered by providers who process your personal data only on instructions from us. They provide us with a hosting service in a cloud computing environment and IT systems for sending email messages.
Location. Our providers are mainly seated in Poland and other countries of the European Economic Area.
State authorities
If requested by authorised state authorities, we make your personal data available in particular to the organisational units of the public prosecutor’s office, the Police, the President of the Personal Data Protection Office, the President of the Office of Competition and Consumer Protection or the Presidents of the Office of Electronic Communications.
6. TERM OF STORING PERSONAL DATA
L.M. Group Poland will process your personal data as long as it is needed or until you withdraw your consent.
If the consent is given only for the participation in one recruitment process, your data will be erased as soon as the recruitment is finished. If the consent is given to having your personal data stored on our database for 3 years for the needs of future recruitment processes, your data will be processed by us for that period in various recruitment processes in order to find a job advertisement that meets your expectations.
When you withdraw your consent, your data will be made anonymous except for the following: given name, surname, electronic mail, history of cooperation and information about consents given (this data will be stored by us for 3 years after erasing the data for the purpose of investigating complaints and claims connected with using our services).
7. APPLICANTS’ RIGHTS REFERRING TO PROCESSING THEIR PERSONAL DATA
We ensure you the recognition of the following rights of yours. You can exercise your rights by submitting your requests to the following email address: contact@lmrecruitment.pl.
Right of access to data
You have the right to: a) gain access to your personal data; b) receive information about the purposes for which your personal data is processed, the categories of processed personal data, its recipients and categories of its recipients, the planned period of having your data stored or the criteria of determining the period, the rights you are entitled to under GDPR,
The right to file complaints to a supervisory authority, the source of the data, and the automated decision-making process, including profiling and security measures applied in relation to having the data transferred outside the European Union; c) receive a copy of your personal data.
Right to update data
You have the right to correct and complete the personal data provided by you. You have the right to request us to have the data corrected (if the data is incorrect) and complete it (if it is incomplete).
Right to withdraw consents
You have the right to withdraw a consent you gave at the moment of applying for jobs we have on offer at any time. The withdrawal of your consent becomes effective at the moment the consent is withdrawn. The withdrawal of the consent does not influence the processing carried out by us lawfully before the withdrawal.
The withdrawal of the consent does not result in any negative consequences to you. However, from the moment of withdrawing the consent you will not be on our database of potential employees and you will not be sent interesting job advertisements.
Right to object to the use of data
You have the right to object at any time to having your personal data used.
If your objection is justified and we do not have any other legal basis to process your personal data, we will erase your data the processing of which you have objected to.
Right to erasure of data (“right to be forgotten”)
You have the right to request to have all or certain personal data erased.
You have the right to request to have your personal data erased if a) you have withdrawn a certain consent, in the scope in which the personal data was processed on the basis of your consent; b) your personal data has stopped to be necessary for the purposes for which it was collected or for which it was processed; c) you have objected to having your data used for marketing purposes; d) your personal data is processed unlawfully.
Despite a request to have personal data erased in relation to making an objection or withdrawing a consent, we have the right to keep certain personal data in the scope needed for the purpose of determining, investigating or defending claims. In particular this refers to personal data such as: given name, surname, electronic mail, data on residency, all of which we keep for the purpose of investigating complaints and claims connected with using our services. Right to limit the processing of personal data
You have the right to request to have the processing of your personal data limited.
You have the right to request to have the processing of your personal data limited in the following cases: a) when you question the correctness of your personal data – in such a situation we will limit the use of the data for the time we need to investigate its correctness, yet for no longer than 7 days; b) when the processing of your personal data is not done in compliance with the law in force, and instead of requesting to have your data erased you decide to request to have its use limited; c) when your personal data has stopped to be needed for the purposes for which we collected or used it, but it is essential to you for the purpose of determining, investigating or defending claims; d) you have objected against having your data used – then the limitation lasts for the time needed to check whether owing to your special situation the protection of your interests, rights and freedoms exceeds the interests we act in when processing your personal data.
Right to transfer data
You have the right to receive your personal data you have provided us with, and then send it to a different administrator of personal data of your choice, e.g. to a different company rendering recruitment services. You have also the right to request us to send your personal data directly to such a different administrator as long as it is technically possible.
Your personal data is then sent in the form of a commonly used readable file that makes the sending of your personal data to a different administrator of personal data possible.
How long does it take us to respond to your request?
If, when exercising the aforementioned rights, you file a request with us, we comply with the request or refuse to comply with it immediately, yet no later than within a month of its receipt. However, if due to the complicated nature of the request or the number of requests we are unable to comply with your request within a month, we will respond to it within the next two months, having informed you earlier about the intended postponing of the deadline.
Submitting complaints, enquiries and requests
You have the right to submit complaints, enquiries and requests referring to the processing of your personal data and the execution of the rights you are entitled to.
If you believe that your right to have your personal data or other rights you are entitled to under GDPR protected has been infringed, you have the right to make a complaint to the Presidents of the Personal Data Protection Office.
8. SAFETY OF PERSONAL DATA
We spare no effort to ensure the safety of your personal data. It is stored on the most secure servers and only authorised staff has access to the IT system.
